Amounts paid out are commercially sensitive

Cllr Marie Moloney: Asked for details on total amount paid out

A total of 16 legal claims have been initiated against Kerry County Council relating to alleged trips and falls in Killarney town since January 2020, it has emerged.

Three of the cases have been finalised and 13 are ongoing.

The information was provided to Cllr Marie Moloney who asked how many claims had been made due to people claiming they tripped over or fell from from footpaths in the town.

She asked how many of the claims had been successful and how much compensation had been paid out in total?

Council officials said the amounts paid out per insurance claim are commercially sensitive and may be protected by data protection legislation so the information cannot be disclosed.

“The payment of compensation to third party claimants is primarily a matter for our insurance company, IPB Insurance, who give a direct indemnity to the council,” the local authority stated.

Cllr Moloney asked for information on the total, non-case specific amount paid out by the council to be provided for the next meeting.
